The Delhi High Court had recently granted Karti Chidambaram an interim protection from arrest. The ED has since filed an appeal in the apex court against the HC decision to grant him any relief.
Karti’s lawyer Kapil Sibal insisted that the HC must be allowed to give a ruling on the subject. The CJI shrugged off his opposition saying, “This is a constitutional court. We will not leave you high and dry.”
The CJI agreed to consider the law in view of the conflicting HC decisions. He clarified that the bench would only deal with the interpretation of the law. He, however, did not heed the ASG’s plea not to extend the interim protection extended to Karti by the HC.
The CJI extended the protection for Karti from arrest till March 26, 2018.
