Pain of Demonetisation may last very long

Although Mr  Modi as well his Ministers have been assuring the people that problems in implementing demonetization due to withdrawal of Rs 500 and Rs 1000 notes from circulation, are only shortlived, yet the impact of the serious cash crunch in the country may lead to adverse impact on the economy. I don’t think even the people who planned the biggest demonetization exercise in the world would ever had thought of the chaos it would create by declaring 86%  of the currency value as zero overnight.

DAS Extension Cases going the Dismissal way

Although, Delhi High Court has started hearing the DAS Deadline related cases transferred from other state high courts on the directions of the Supreme Court, most of the cases may get dismissed giving no relief to the MSOs of Phase III.

DD lags behind in Digitisation

While the MIB is in a haste to force private Cable TV networks to go digital by the end of the year, its own house is not in order. Doordarshan, the public Broadcaster having all the support of the government including budgetary support is way behind completing its digitisation. Doordarshan’s digitisation plans were made in 2006, much before the DAS amendment to the Cable TV Act was made in 2011.

GST Rates Approved

India's biggest tax reform is taking shape at a faster speed than expected. On 03 November, the GST Council announced a four-tier rate structure for the Goods and Services Tax (GST). The new indirect tax regime will have four main tax slabs - 5 per cent, 12 per cent, 18 per cent and 28 per cent, and is expected to come into force from April 1, 2017.

The TRAI consultation paper on Infrastructure sharing in Broadcasting TV Distribution sector has been issued at a time when it is needed the most. This paper brings an opportunity for the industry to think together and cooperate at all levels to the welfare of all the stake holders and provide the best service, choice at an economical manner to the consumer. With digitisation, great amount of expenses are being incurred by every stake holder in the distribution networks. Sharing of infrastructure can really help to ease the situation reducing the Capex to a great extent.

TRAI ensures Quality Services to Consumers

TRAI has earlier issued Quality of Service (QoS) regulations for different television delivery platforms in broadcasting sector from time to time with a view to ensure better quality of TV broadcasting services to the consumers. These regulations were issued when the digital revolution in the broadcasting sector and use of ICT technologies for managing QoS & complaint redressal were at the nascent stage. In today’s digital broadcasting scenario where substantial digitalization has been achieved, the basic QoS provision and performance parameters are largely similar across the television distribution platforms. Subscription of services, complaint redressal and even the consumption of services have become platform agnostic. In digital environment, consumer awareness about the service offerings, ease in subscription, service management and redressal of consumer complaints by the service providers in a time bound manner are vital areas of concern to ensure good quality of service to consumers. Optimum utilization of ICT technologies will go a long way in ensuring better quality of television broadcasting services.

The Regulated vs the Regulator

Participating in a discussion at the 5th Annual Media, Advertising & Entertainment legal summit  2016 on 20 October titled ‘ the Good old Media Wars- The Regulated Vs the Regulators’, I felt  that title of the discussion should have been the ‘unregulated vs the Regulator’ because till date Broadcast sector does not have any section of the Industry regulated except of course, thousands of Small Cable TV Operator’s who are regulated by Cable TV Act of 1995 but being very small and too widespread, have no strength to fight the Regulator. Being not so conversant with English language in which all are regulations are written, they do not even understand what the regulator has in store for them.

The Telecom Regulatory Authority of India (TRAI) released a draft Telecommunication (Broadcasting and Cable Services) (Eighth) (Addressable Systems) Tariff Order, 2016 on 10 October 2016. The draft Tariff Order aims to create an enabling environment for orderly growth of the television broadcasting sector in the light of various developments related to technology, emergence of multiple distribution platforms, evolving business models, and enhanced addressability across platforms.

DAS Extension Cases getting Dismissed

The Delhi High Court has started hearing the cases for DAS extension, transferred from other High Courts of other states on the orders of the Supreme Court of India. The result so far is not encouraging as in all the cases taken up last month, eight cases related to extension of DAS Phase-III have been dismissed.

LCOs and Consumers missing from the Task Force

Just after three months on 31st December 2016 our Government will declare the great job of Mandatory Digitisation completed successfully. The Ministry of Information and Broadcasting will issue directions to the broadcasters to switch off all their analogue  decoders, cutting off the signal supply to television sets in millions of poor households of Phase III & IV who cannot afford a DTH connection and where cable operator does not have access to digital signal because  either MSOs  do not have any existing infrastructure there or hesitate to enter as economically not viable.
