TDSAT said the excess amount cannot be used for other payments. It asked DoT to return the money before January 29, the next date for hearing. TDSAT has also sought a rejoinder from RCom within three weeks on its reservations about the adjusted amount of Rs 30.33 crore.
Telecom Disputes Settlement and Appellate Tribunal (TDSAT) order dated December 21 comes after RCom’s plea that the department return the remainder after encashing bank guarantees of Rs. 908 crore against spectrum charges of Rs 774 crore. DoT has already adjusted Rs 30.33 crore.
TDSAT said: “The remaining amount of Rs. 104.34 is lying and unadjusted amount should be returned to the petitioner without prejudice to rights of either party for any other charges which the petitioner may be found to be liable to pay.”
